ROI Guarantee Terms & Conditions

Performance Guarantee

Subject to the terms and conditions below, Company guarantees that Client will achieve a positive return on investment (“ROI”) from advertising services within ninety (90) days of the contract’s effective date (the “Guarantee Period”), or Client may request a refund of fees paid during the Guarantee Period.

Conditions of Guarantee

This guarantee is strictly contingent upon Client’s full compliance with all of the following requirements:

a. Sales Training. Client completes Company’s required sales training prior to Client’s approval and subsequent launch of any advertising campaigns and follows the required intake, follow-up, and close procedures taught in the training.

b. CRM Use. Client uses Company’s designated CRM for all lead capture, pipeline management, and job status tracking for the campaigns covered by this Agreement, including accurate and timely updates of lead dispositions and outcomes.

c. Call Tracking. Client allows Company to implement and maintain Company’s call tracking system on all advertising campaigns to ensure all inbound calls are properly recorded and tracked.

d. Lead Response Time. During Client’s stated business hours, Client maintains a callback/first-response time of thirty (30) minutes or less for at least 90% of new leads generated by the campaigns. “First response” means a live answered call or an outbound call/text/email attempt that is logged in the CRM.

e. Minimum Time/Spend. Client allows advertising campaigns to run for at least thirty (30) days and spends at least $1,000 in advertising spend prior to requesting a refund.

Refund Request Procedure

a. Written Request Deadline. To claim a refund, Client must submit a written request to billing@freshcoat.io no later than the 90th day after the Effective Date. Requests submitted after this deadline are void.

b. Refund Amount. If Client is eligible and the ROI Threshold was not achieved, Company will refund the Company management/service fees actually paid by Client during the Guarantee Period. Advertising spend and any other third-party expenses are non-refundable.

c. Sole Remedy. The refund described above is Client’s sole and exclusive remedy for any failure to achieve the ROI Threshold.
